Supreme Court accepts one new case

Madison, Wisconsin - December 9, 2004

Madison, Wis. (Dec. 9, 2004) – The Wisconsin Supreme Court has voted to grant review in one new case. The case number, issues (provided by the Office of the Clerk of Supreme Court), and county of origin are listed below. 03-2255 State v. Lisimba Love

Issues: Did a telephone call to the defendant’s mother from an alleged inmate of the county jail meet the standard for requiring an evidentiary hearing in a postconviction motion proceeding as set forth in State v. Bentley, 201 Wis. 2d 303, 438 N.W.2d 50 (1996) and State v. Allen 2004 WI 106, ___ Wis. 2d ___, 682 N.W.2d 433, which requires a hearing only when the party asking for the hearing states sufficient material facts that, if true, would entitle the defendant to relief?

Was trial counsel ineffective because counsel failed to investigate the telephone call to the defendant’s mother? From Milwaukee County.
