New court eFiling rule takes effect statewide today

A new Supreme Court rule governing the filing of all electronic documents and cases in Wisconsin circuit courts takes effect today, July 1.

Anyone filing circuit court documents electronically will need to adhere to provisions of the new "mandatory eFiling rule," which replaces a rule that previously governed voluntary eFiling. The old eFiling rule has been repealed, and the procedures of new Wis. Stat. § 801.18 now apply to all eFiled cases, whether voluntary or mandatory, in all counties.

Although provisions of the new rule take effect today for all eFiled documents and cases, the mandatory implementation of eFiling will occur on a county-by-county and case-type basis during the next several years. The Wisconsin court system's eFiling webpage provides important information, including the current roll out schedule and video tutorials and written guides for using the new eFiling system. This system supports the new rule and offers many new features for users.

Today, Ozaukee County Circuit Court became the second county to require electronic filing for civil, family, small claims, and paternity cases. Ozaukee County Circuit Court joins Dodge County Circuit Court, which successfully served as a pilot county during June. Both counties also offer voluntary eFiling for criminal felony and misdemeanor cases.

On Aug. 1, Columbia and Jefferson counties will require electronic filing for civil, family, small claims, and paternity cases, followed by Adams, Pierce, and Waupaca counties on Aug. 15.
