SUPREME COURT OF WISCONSIN

______________________________________________________________

In the Matter of the Adoption of Supreme

Court Rule 74.01:  Filing of Papers             ORDER

Required by the Rules of Appellate              No. 96-12

Procedure, Wis. Stat. Chapter 809

_______________________________________________________________

The Rules of Appellate Procedure specify that any paper required to be filed by those rules be filed with the clerk of the court, State Capitol, Madison, WI 53702, "unless a different place of filing is expressly required or permitted by statute or rule."  Wis. Stat. sec. (Rule) 809.80(1).   The office of the clerk of the Supreme Court and of the Court of Appeals is being relocated and will no longer be located in the State Capitol.  Accordingly, the court, on its own motion, adopts the following rule, consistent with Wis. Stat. sec. (Rule) 809.80(1), specifying where papers required to be filed by the Rules of Appellate Procedure shall be filed.

IT IS ORDERED that, effective September 23, 1996, chapter 74 (title) and sec. 74.01 (1) and (2) of the Supreme Court Rules are created to read:

                        SCR CHAPTER 74

                 SUPREME COURT ADMINISTRATION

SCR 74.01   Filing papers under the rules of appellate procedure.  (1) Papers required to be filed by the rules of appellate procedure, Wis. Stat. chapter 809, shall be filed with the clerk of the court, 110 East Main Street, Madison, WI 53703.

     (2) The mailing address of the clerk of the Supreme Court and of the Court of Appeals is P. O. Box 1688, Madison, WI 53701-1688.  IT IS FURTHER ORDERED that notice of the adoption of this amendment of the Supreme Court Rules be given by a single publication of a copy of this order in the official state newspaper and in an official publication of the State Bar of Wisconsin.

Dated at Madison, Wisconsin, this 17th day of September, 1996.                             BY THE COURT:
