By order dated May 14, 2010, the Wisconsin Supreme Court granted a petition filed by the State Bar of Wisconsin (State Bar) and the Office of Lawyer Regulation (OLR) and established procedures for lawyer support and monitoring within the State Bar and for the OLR to refer lawyers for assessment, treatment, and monitoring.

The order further provided that "three years after the effective date of this order the petitioners, the State Bar of Wisconsin and the Office of Lawyer Regulation, shall provide the court with a written report advising the court of the impact of the adoption of SCR 10.05(4)(m)."

On September 19, 2013, the State Bar and the OLR together filed a report with the Wisconsin Supreme Court in response to the May 14, 2010 order.  The report provided information from both the State Bar and the OLR, indicating that 36 lawyers had entered the lawyer support and monitoring program from the effective date of SCR 10.05(4)(m) through the date of the report, and that "49 volunteer attorneys have been formally trained to be monitors for program participants."  Charts were also included in the report showing the percentage of referrals by referral source, by gender, by the impairment for which they are being monitored, and by status of compliance or non-compliance within the program.  Overall, the State Bar and the OLR reported that, "[w]hile the time since the program's inception is too short to evaluate its effectiveness fully, the results to date are very encouraging." 

The court noted its acceptance of the report at an open rules conference on October 25, 2013, deeming the State Bar and the OLR to have satisfied the three-year reporting requirement set forth in the May 14, 2010 order.  Therefore,

IT IS ORDERED that the requirement of this court's May 14, 2010 order, that the State Bar of Wisconsin and the Office of Lawyer Regulation file a written report three years after the effective date of the order advising the court of the impact of the adoption of Supreme Court Rule 10.05(4)(m), is deemed satisfied.
