On November 20, 2003, this Court issued an order deferring consideration of a pending petition filed by the Wisconsin Courts Fee Arbitration Study Committee ("Fee Arbitration Study Committee"), chaired by Attorney Donald J. Christl.  The Court requested that the Fee Arbitration Study Committee develop a number of the important issues addressed at the public hearing on the petition and requested further that the Fee Arbitration Study Committee submit supplemental materials for the Court's consideration in connection with Petition No. 04-07, In re Petition for Amendment to Supreme Court Chapter 20 — Rules of Professional Conduct for Attorneys ("Ethics 2000").  The Court declined to take action on the proposal to amend SCR 31.02(2).

On December 28, 2004, the Fee Arbitration Study Committee filed a response to the Wisconsin Ethics 2000 Committee Petition. Additional correspondence and substantive written recommendations were submitted on November 7, 2005, January 27, 2006, July 17, 2006 and August 11, 2006, and Attorney Christl appeared and participated extensively in the Court's consideration of proposed amendments to SCR 20:1.5 (Fees).  The Fee Arbitration Study Committee's participation in the Ethics 2000 proceeding was very valuable to this Court.

On January 5, 2007, the Court issued an order repealing and recreating the Rules of Professional Conduct for Attorneys, (2007 WI 8, No. 04-07) including revisions to the language and comments of SCR 20:1.5 (Fees). 

Therefore,

IT IS ORDERED that the petition filed in the matter of amendment of Supreme Court Rule 20:1.5(b) and creation of Supreme Court Rule 20:1.5(f) regarding written communication on fees and the amendment of Supreme Court Rule 31.02 regarding continuing legal education credits for ethics is dismissed.
