                        GARTZKE, P.J.  The State appeals from a judgment acquitting Kurt Warrington of operating a motor vehicle with a blood alcohol concentration (BAC) of .10% or more, contrary to § 346.63(1)(b), Stats., second offense, a misdemeanor.[1]  The issues are (1) whether, as the trial court concluded, admitting
