Before Higginbotham, Sherman and Kloppenburg, JJ.

By prior order in this no-merit appeal, we directed Attorney Steven Zaleski to review whether a postconviction motion challenging the DNA surcharge ordered at sentencing or the subsequent restitution order would have arguable merit. Attorney Zaleski now informs us he intends to file a postconviction motion raising those issues.

Therefore,

IT IS ORDERED that this appeal is dismissed without prejudice.

IT IS FURTHER ORDERED that the time to file a postconviction motion or notice of appeal is extended to November 20, 2014.
