By order dated December 9, 2014, this court directed Attorney Andrea Taylor Cornwall to file a supplemental no-merit report on behalf of James Johnson. Upon this court’s independent review, we questioned whether, based on the facts established by the record, there was any arguable merit to challenging use of a domestic abuse modifier or imposition of the domestic abuse surcharge. Attorney Cornwall, on behalf of Johnson, now moves to dismiss the appeal and seeks an extension of time for filing a supplemental postconviction motion in order to address additional arguably meritorious issues that counsel has identified.
Upon the foregoing,
IT IS ORDERED that the no-merit report in appeal No. 2014AP1537-CRNM is rejected and the appeal is dismissed without prejudice.
IT IS FURTHER ORDERED that the deadline for filing a supplemental postconviction motion or notice of appeal in Milwaukee County Circuit Court case No. 2013CF1700 is extended to February 20, 2015.
