Counsel for Paul Linde filed a no-merit report concluding there is no arguable basis for appealing Linde’s conviction and sentence. Upon our independent review of the record, we are unable to conclude that there is no arguable basis for appeal of the circuit court’s order denying the motion to suppress evidence based on lack of probable cause to support the search warrant. Therefore,

IT IS ORDERED that the no-merit report is rejected. The appellant shall file a merit brief within forty days of the date of this order.
