In the Matter of the Amendment of

Supreme Court Rules:  Review of            ORDER

Proposed Rules -- SCR 98.03                No. 96-09

     The court, on its own motion, has considered the advisability of amending the rule, SCR 98.03, providing for review and suggestions as to drafting style and numbering of proposed amendments to the Supreme Court Rules to specify that the confidential treatment of the review and suggestions applies to the chief and staff of the Legislative Reference Bureau and to the Revisor of Statutes, to whom proposed rules are sent for review and suggestions.  The court, in its discretion, may provide the suggestions filed with the court to the rule proponents and other interested persons prior to the public hearing on the proposal or court action on it. 

     IT IS ORDERED that, effective the date of this order, SCR 98.03 is amended to read: 

     SCR 98.03  Review of language.

     Prior to adoption, a proposed rule shall be submitted to the director of state courts.  Copies of the proposed rule shall be sent for review and suggestions as to drafting style and numbering to the chief of the legislative reference bureau and the revisor of statutes for review and suggestions as to drafting style and numbering.  The , who shall treat the review and any suggestions shall be treated as confidential prior to the issuance of an order by the supreme court adopting the rule.  The procedure specified in this rule shall be followed unless the supreme court determines there is insufficient time to use the procedure prior to the required adoption of a rule. 

     IT IS FURTHER ORDERED that notice of this amendment of the Supreme Court Rules shall be given by a single publication of a copy of this order in the official state newspaper and in an official publication of the State Bar of Wisconsin.
