ORDER

No. 97-10

 

     By order of October 15, 1998, the court adopted chapter 75 of the Supreme Court Rules, effective January 1, 1999, providing for the appointment, performance evaluation, continuing education, and discipline of circuit court commissioners.  Supreme Court Rule 75.02 provides that a chief judge is to authorize circuit court commissioners to perform “one or more specific duties allowed court commissioners by statute and approved by the supreme court.” 

     By order of December 2, 1998, in No. 97-10, the court approved for purposes of SCR 75.02 the duties allowed court commissioners by statute as of January 1, 1999.

     Thereafter, 1999 Wisconsin Act 9, Section 3054de, effective May 1, 2000, created Wis. Stat. § 767.242, entitled “Enforcement of physical placement orders,” and specified additional duties of court commissioners in actions affecting the family.  In

 

addition, 1997 Wisconsin Act 192, Section 17, effective January 1, 2000, created Wis. Stat. § 757.69(1)(n), and specified additional duties of court commissioners in actions involving disposition of animals. 

     The court, on its own motion, has considered it advisable to approve those duties for purposes of SCR 75.02.

     IT IS ORDERED that, effective the date of this order, the specific duties approved by the Supreme Court for purposes of SCR 75.02 are those allowed court commissioners by statute as of January 1, 1999, by 1999 Wisconsin Act 9, Section 3054de, and by 1997 Wisconsin Act 192, Section 17.

     IT IS FURTHER ORDERED that notice of this amendment of the Supreme Court Rules be given by a single publication of a copy of this order in the official state newspaper and in an official publication of the State Bar of Wisconsin.
